These Terms & Conditions (“Terms”) govern access to and use of the Elite Fly Aviation website and any enquiries, requests or communications submitted through it.

Please read these Terms carefully before using this website.

By accessing or using this website, you acknowledge that you have read and understood these Terms and agree to be bound by them, subject always to any mandatory rights available to you under applicable law.

2. SCOPE OF THESE TERMS

These Terms apply principally to:

  • use of this website;

  • information displayed on the website;

  • enquiries submitted to Elite Fly Aviation;

  • requests for quotations;

  • requests relating to passenger aviation, private aircraft charter, cargo services, commercial brokerage and associated aviation services.

These Terms do not, by themselves, constitute the complete contractual terms applicable to an aircraft charter, passenger transport, cargo movement or other aviation transaction.

Any confirmed service may be subject to a separate quotation, booking confirmation, charter agreement, cargo agreement, operator terms, conditions of carriage or other transaction-specific documentation.

Where transaction-specific terms conflict with these website Terms, the transaction-specific terms shall prevail in relation to that transaction, subject to applicable mandatory law.

3. NATURE OF OUR SERVICES

Elite Fly Aviation provides aviation-related services within the scope of its applicable licences and authorisations.

Depending on the particular transaction, Elite Fly Aviation may act as an arranger, broker, commercial intermediary, facilitator, contracting party or in another capacity expressly identified in the relevant booking documentation.

Unless Elite Fly Aviation is expressly identified in writing as the operating air carrier, the aircraft used for a journey may be owned and/or operated by an independent third-party licensed aircraft operator.

In such circumstances, operational control of the aircraft, including decisions concerning safety, crew, aircraft operation, weather, routing and operational suitability, remains with the relevant licensed aircraft operator and its flight crew.

Nothing on this website should be interpreted as representing that Elite Fly Aviation owns, manages or directly operates every aircraft displayed or referred to on the website.

4. WEBSITE INFORMATION IS NOT A BINDING OFFER

Information contained on this website is provided for general informational and marketing purposes.

Aircraft images, specifications, cabin configurations, passenger capacity, range, flight duration, routes, availability, amenities, airport information and other aviation information may vary.

Aircraft performance figures may be based on manufacturer data and can be affected by factors including aircraft configuration, payload, passenger count, baggage, weather, winds, routing, airport elevation, runway conditions, fuel requirements, air traffic restrictions and other operational considerations.

No aircraft, price, itinerary or service displayed on this website constitutes a binding offer unless expressly confirmed in writing by Elite Fly Aviation.

5. QUOTATIONS AND BOOKINGS

All requests submitted through the website are requests for information or quotations only.

A request does not constitute a confirmed booking.

Unless expressly stated otherwise in writing, quotations:

  • are subject to aircraft and crew availability;

  • are subject to operator approval;

  • may be subject to airport slots, permits and handling availability;

  • may be withdrawn or amended before confirmation;

  • may exclude additional costs that cannot reasonably be determined at the quotation stage.

A booking becomes binding only when the applicable confirmation requirements communicated by Elite Fly Aviation have been satisfied, which may include written acceptance, execution of contractual documentation and receipt of required payment.

6. AIRCRAFT AVAILABILITY AND SUBSTITUTION

Aircraft availability can change rapidly.

Where the originally proposed aircraft becomes unavailable for operational, technical, regulatory, safety or other legitimate reasons, Elite Fly Aviation may attempt to identify a suitable alternative through its aviation network.

Any alternative aircraft, additional cost or material change shall be communicated in accordance with the relevant booking terms and applicable law.

Images on the website are representative unless expressly stated to depict the specific aircraft allocated to a confirmed journey.

Interior configurations and amenities may vary between individual aircraft of the same model.

7. THIRD-PARTY AIRCRAFT OPERATORS AND SERVICE PROVIDERS

Elite Fly Aviation may work with independent:

  • aircraft operators;

  • airports and FBOs;

  • ground handlers;

  • catering companies;

  • transportation providers;

  • cargo operators;

  • freight and logistics providers;

  • security providers;

  • payment processors;

  • and other specialist aviation service providers.

Such parties may provide their services under their own contractual terms, regulatory obligations and operational procedures.

Where Elite Fly Aviation acts solely as an intermediary or broker, it shall not be deemed to assume operational responsibilities legally allocated to the independent service provider, except to the extent otherwise expressly agreed or required by applicable law.

8. PASSENGER RESPONSIBILITIES

Passengers and persons arranging travel are responsible for providing complete and accurate information required for the journey.

This may include passenger names, passport information, nationality, travel documentation, visa requirements, baggage information and any relevant special requirements.

Passengers remain responsible for ensuring that they possess all passports, visas, permits, health documentation and other documents required by the authorities of the origin, transit and destination jurisdictions.

Elite Fly Aviation may assist with information or coordination, but unless expressly agreed otherwise, such assistance does not constitute immigration, legal or regulatory advice.

Passengers must comply with applicable laws, airport security requirements, operator instructions and lawful instructions of the aircraft commander and crew.

Carriage may be refused where required or permitted by applicable law, safety requirements, operator rules or competent authorities.

9. BAGGAGE AND SPECIAL ITEMS

Baggage capacity depends on the specific aircraft and passenger load.

Clients must disclose unusual, oversized, valuable, fragile or restricted items before confirmation.

Weapons, dangerous goods, hazardous materials, prohibited substances and other regulated articles may not be carried unless permitted by applicable law and specifically accepted by the relevant operator and competent authorities.

Elite Fly Aviation does not guarantee acceptance of any special item merely because it has been disclosed.

10. CARGO SERVICES

Clients requesting cargo transportation must provide accurate information concerning the cargo, including its description, quantity, dimensions, weight, packaging, origin, destination and any special handling or regulatory requirements.

Restricted, dangerous, hazardous or regulated goods must be clearly disclosed before any service is confirmed.

Cargo transportation remains subject to:

  • operator acceptance;

  • aircraft suitability;

  • airport capabilities;

  • customs requirements;

  • security requirements;

  • export/import restrictions;

  • dangerous goods regulations;

  • sanctions restrictions;

  • and all other applicable laws and permits.

Elite Fly Aviation may decline any cargo request that it reasonably considers unlawful, unsafe, insufficiently documented or outside the capabilities or approvals of available operators.

11. PRICES, TAXES AND ADDITIONAL CHARGES

Prices are determined according to the specific requirements of each mission.

Unless expressly stated otherwise, additional charges may arise from circumstances including:

  • airport fees;

  • parking;

  • de-icing;

  • additional ground handling;

  • catering upgrades;

  • ground transportation;

  • additional flight time;

  • route changes;

  • overnight crew requirements;

  • passenger-requested changes;

  • additional permits;

  • taxes or governmental charges;

  • and services requested after the original quotation.

No additional charge shall override mandatory consumer rights under applicable UAE law.

12. PAYMENT

Payment methods, currency, deadlines and applicable payment conditions will be stated in the relevant quotation, invoice or booking documentation.

Elite Fly Aviation may require full or partial payment before confirming or performing a service.

A service may remain unconfirmed until cleared funds are received where payment is a condition of confirmation.

Clients must not make payments to bank accounts or payment instructions that have not been formally communicated through authorised Elite Fly Aviation channels.

Elite Fly Aviation may perform reasonable verification before accepting or releasing funds.

13. CANCELLATIONS, CHANGES AND REFUNDS

Cancellation, change and refund conditions may vary significantly according to the aircraft operator, aircraft repositioning, mission, route and timing.

Accordingly, the specific cancellation and refund conditions applicable to a booking will be stated in the relevant quotation, booking confirmation or contractual documentation.

No general statement on this website overrides rights that a consumer cannot lawfully waive under applicable UAE legislation.

Where Elite Fly Aviation acts as an intermediary, any refund may also depend upon sums recoverable from the relevant operator or service provider, subject to applicable law and the specific contractual arrangement.

14. DELAYS, DIVERSIONS AND OPERATIONAL CHANGES

Private aviation remains subject to operational circumstances.

Departure or arrival times may be affected by matters including:

  • weather;

  • air traffic control;

  • airport closures;

  • slots;

  • crew duty limitations;

  • technical issues;

  • security events;

  • governmental restrictions;

  • permits;

  • force majeure;

  • and other circumstances beyond reasonable control.

The aircraft commander and relevant operator retain authority over decisions affecting operational safety.

Where a journey is delayed, diverted, rescheduled or cancelled, the applicable booking terms and mandatory laws will determine the respective rights and obligations of the parties.

15. COMPLIANCE, KYC AND PROHIBITED TRANSACTIONS

Elite Fly Aviation may request information or documentation reasonably required to comply with applicable legal, regulatory, security, sanctions, KYC, anti-money laundering, anti-fraud or other compliance obligations.

Elite Fly Aviation reserves the right, subject to applicable law, to refuse, suspend or terminate a transaction where:

  • required by a competent authority;

  • the transaction may breach applicable law or sanctions;

  • required information is not provided;

  • information appears materially inaccurate or misleading;

  • payment raises legitimate compliance concerns;

  • or continuing the transaction could expose Elite Fly Aviation or its partners to unlawful activity or material regulatory risk.

Elite Fly Aviation shall have no obligation to perform an unlawful transaction.

16. ACCEPTABLE USE OF THE WEBSITE

Users must not misuse the website or attempt to interfere with its security or operation.

Prohibited conduct includes unauthorised access, malicious software, automated attacks, fraudulent enquiries, impersonation, scraping contrary to applicable law, interference with website infrastructure or use of the website for unlawful purposes.

Elite Fly Aviation may restrict or terminate access where reasonably necessary to protect its systems, users or legitimate interests.

17. INTELLECTUAL PROPERTY

Unless otherwise indicated, the website design, Elite Fly Aviation branding, text, graphics and original website content are owned by or licensed to Elite Fly Aviation and are protected by applicable intellectual property laws.

No content may be reproduced, commercially exploited, modified or distributed without prior written permission, except where permitted by applicable law.

Aircraft manufacturer names and trademarks remain the property of their respective owners.

References to manufacturers or aircraft do not imply endorsement, partnership or affiliation unless expressly stated.

18. THIRD-PARTY LINKS

The website may contain links to third-party websites.

Such links are provided for convenience and do not constitute endorsement of the third party.

Elite Fly Aviation does not control third-party websites and is not responsible for their content, availability, security or privacy practices.

19. DISCLAIMER

Elite Fly Aviation uses reasonable efforts to maintain accurate website information but does not warrant that all website content will at all times be complete, current or error-free.

To the maximum extent permitted by applicable law, the website is provided on an “as available” basis.

Nothing in these Terms excludes any warranty, obligation or consumer right that cannot lawfully be excluded.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Elite Fly Aviation shall not be liable merely as a result of website use for indirect, incidental, special or consequential losses, loss of opportunity, loss of profits or loss arising from reliance on general website information.

Liability arising from an actual booked aviation service shall be governed by the applicable booking agreement, conditions of carriage, relevant operator terms, applicable UAE law and, where applicable, international conventions governing air transportation.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

21. FORCE MAJEURE

Elite Fly Aviation shall not be responsible for failure or delay to the extent caused by circumstances beyond its reasonable control, subject always to applicable mandatory law.

Such circumstances may include severe weather, natural disasters, war, civil disturbance, terrorism, governmental action, sanctions, epidemics, airport closure, airspace closure, air traffic restrictions, labour disruption, infrastructure failure or other comparable events.

The consequences of a force majeure event for a confirmed transaction will be governed by the applicable booking documentation and law.

22. PRIVACY

Personal Data collected through the website is processed in accordance with the Elite Fly Aviation Privacy Policy and applicable data protection legislation.

23. CHANGES TO THESE TERMS

Elite Fly Aviation may amend these Terms to reflect legal, regulatory, operational or website changes.

Any revised version will be published on this website with an updated effective date.

Changes will not retrospectively alter a confirmed transaction except where legally required or agreed by the relevant parties.

24. SEVERABILITY AND NO WAIVER

If any provision is held invalid or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.

Failure by Elite Fly Aviation to enforce any provision on one occasion does not constitute a waiver of its right to enforce that provision later.

25. GOVERNING LAW AND JURISDICTION

These Terms and use of the website shall be governed by the applicable laws of the United Arab Emirates and the Emirate of Dubai, without prejudice to any mandatory rights or jurisdiction available under applicable law.

Subject to mandatory legal requirements and any different dispute mechanism expressly agreed in transaction-specific documentation, disputes shall be submitted to the courts of Dubai having competent jurisdiction.
